תנאי שימוש אלו מהווים הסכם משפטי מחייב בינך לבין PhishingU בע"מ. אנא קרא בעיון לפני השימוש באתר. המשך השימוש באתר מהווה הסכמה מלאה לתנאים אלו.
מבוא
ברוכים הבאים לאתר PhishingU (להלן: "האתר"). האתר מופעל על ידי PhishingU בע"מ (להלן: "החברה", "אנו", "שלנו"). השימוש באתר ובשירותים המוצעים בו כפוף לתנאי השימוש המפורטים להלן. בכניסה לאתר ושימוש בו, הנך מאשר כי קראת, הבנת והסכמת לתנאים אלו. אם אינך מסכים לתנאים, אנא הימנע משימוש באתר.
שם החברה ופרטי התאגיד
האתר מופעל על ידי PhishingU בע"מ, חברה ישראלית המספקת שירותי סימולציות פישינג, הדרכות אבטחת מידע והעלאת מודעות לאיומי סייבר. כל הפניה ל'החברה' או 'PhishingU' מתייחסת ל-PhishingU בע"מ.
קניין רוחני וזכויות יוצרים
כל תוכן, עיצוב, גרפיקה, טקסטים, תמונות, סימנים מסחריים, לוגואים, קוד מקור, קוד תוכנה, מאמרים, מדריכים ו/או כל חומר אחר המופיע באתר זה (להלן: "התכנים") הינם קניינה הבלעדי של PhishingU בע"מ או של צדדים שלישיים שהתירו את השימוש בהם, והם מוגנים על פי חוקי זכויות יוצרים, סימני מסחר וקניין רוחני בישראל ובעולם. אין להעתיק, לשכפל, להפיץ, למכור, לפרסם, לשנות, ליצור עבודות נגזרות או לעשות כל שימוש מסחרי או לא מסחרי בתכנים ללא קבלת הסכמה מפורשת בכתב מהחברה. העתקת תכנים, עיצוב, קוד או כל חומר מהאתר מהווה הפרת זכויות יוצרים וקניין רוחני ועלולה להוביל לצעדים משפטיים. שם 'PhishingU', הלוגו של החברה וסימנים מסחריים נוספים הינם קניינה הבלעדי של PhishingU בע"מ.
שימוש מותר באתר
אתה רשאי להשתמש באתר למטרות אישיות ועסקיות לגיטימיות בלבד. אסור לעשות שימוש באתר למטרות בלתי חוקיות, להפר את זכויות אחרים, להעלות תוכן פוגעני או זדוני, לפגוע בתפעול האתר או לנסות לחדור למערכות האתר.
שירותי החברה
PhishingU מספקת שירותי סימולציות פישינג, הדרכות אבטחת מידע, תרגילי צוות אדום ושירותי ייעוץ אבטחה נוספים (להלן: "השירותים"). תיאור השירותים באתר הינו כללי בלבד ואינו מהווה הצעה מחייבת. כל התקשרות בשירות כפופה להסכם נפרד בין החברה לבין הלקוח. החברה שומרת לעצמה את הזכות לשנות, להוסיף או להסיר שירותים בכל עת וללא הודעה מוקדמת.
אחריות והגבלת אחריות
האתר והתכנים בו מוצגים "כמות שהם" (AS IS) וללא כל אחריות מכל סוג. החברה אינה מתחייבת לזמינות רצופה של האתר ואינה אחראית לכל נזק ישיר או עקיף שיגרם כתוצאה משימוש או אי-יכולת להשתמש באתר. החברה אינה אחראית לדיוק, שלמות או עדכניות של המידע באתר. כל הסתמכות על מידע המופיע באתר היא באחריותך הבלעדית. החברה לא תישא באחריות לכל נזק, הפסד, אובדן רווחים, נזקים עקיפים או תוצאתיים הנובעים משימוש באתר.

מדיניות סריקת חשיפה לפישינג
שירות סריקת החשיפה לפישינג (להלן: "שירות הסריקה") מאפשר לך לבדוק את מצב רשומות האימות של הדומיין שלך (DMARC, SPF, DKIM) ולקבל הערכת סיכון ראשונית. שירות זה כפוף לתנאים הבאים: א. הרשאת סריקה: אתה מצהיר ומאשר כי אתה הבעלים של הדומיין שנסרק, או שקיבלת הרשאה בכתב מפורשת מבעל הדומיין לבצע את הסריקה. סריקה ללא הרשאה מהווה הפרה של תנאי שימוש אלו ועלולה לעלות כדי עבירה פלילית. ב. אופי הסריקה: הסריקה בודקת רשומות DNS ציבוריות בלבד (DMARC, SPF, DKIM). שירות הסריקה המלאה (EASM) בודק נכסים חיצוניים וציבוריים הגלויים ברשת. הסריקה אינה פולשנית - לא מתבצעת כל גישה ישירה למערכות, לשרתים פנימיים, לרשת הפנימית או לנכסים שאינם ציבוריים, ולא נדרשת כל הרשאת גישה מוקדמת. ג. מגבלות השירות: תוצאות הסריקה הן בגדר הערכה ראשונית בלבד ואינן מהוות ייעוץ אבטחה מקצועי. ממצאי הסריקה עשויים להיות חלקיים ואינם מהווים תחליף לסקר אבטחה מקצועי מקיף. PhishingU אינה אחראית להחלטות שיתקבלו על סמך תוצאות הסריקה. ד. שימוש בנתונים: כתובת המייל שתספק לצורך קבלת הדוח תישמר ותשמש לשליחת הדוח הנדרש. בכפוף להסכמתך, ייתכן שנשלח לך מידע נוסף בנושאי אבטחת סייבר. ה. הגבלות שימוש: חל איסור מוחלט להשתמש בשירות הסריקה לבדיקת דומיינים ללא הרשאה, לצרכי תחרות עסקית, או לכל מטרה אחרת שאינה לגיטימית.
שינויים בתנאי השימוש
החברה רשאית לעדכן ולשנות את תנאי השימוש בכל עת. שינויים ייכנסו לתוקף מרגע פרסומם באתר. המשך השימוש באתר לאחר פרסום שינויים מהווה הסכמה לתנאים המעודכנים. מומלץ לבדוק את תנאי השימוש מעת לעת.
סמכות שיפוט ודין חל
תנאי שימוש אלו כפופים לדיני מדינת ישראל בלבד. כל מחלוקת הנובעת מתנאים אלו תידון בבתי המשפט המוסמכים במחוז תל אביב-יפו, בישראל.
שיפוי
הנך מתחייב לשפות את החברה, עובדיה, מנהליה ושותפיה בגין כל נזק, הפסד, תביעה או הוצאה שייגרמו להם כתוצאה מהפרת תנאי שימוש אלו על ידך או כתוצאה משימושך באתר.
הפרדה
אם יקבע כי סעיף מסוים בתנאי שימוש אלו אינו תקף או בר-אכיפה, הדבר לא ישפיע על תקפות יתר הסעיפים. הסעיפים האחרים ימשיכו להיות בתוקף מלא.
שימוש בשם ובלוגו של החברה
אין להשתמש בשם 'PhishingU', בלוגו של החברה או בכל סימן מסחרי אחר השייך לחברה ללא אישור מפורש בכתב מהחברה. כל שימוש לא מורשה יהווה הפרת זכויות קניין רוחני.

Welcome to the PhishingU website ("the Site"). The Site is operated by PhishingU Ltd. ("the Company", "we", "our"). Use of the Site and services offered therein is subject to the terms of use detailed below. By accessing and using the Site, you confirm that you have read, understood and agreed to these terms. If you do not agree to the terms, please refrain from using the Site.

The Site is operated by PhishingU Ltd., an Israeli company providing phishing simulation services, information security training and cyber threat awareness. Any reference to 'the Company' or 'PhishingU' refers to PhishingU Ltd.

Permitted Use of the Site
You may use the Site for legitimate personal and business purposes only. You may not use the Site for illegal purposes, violate the rights of others, upload offensive or malicious content, harm the Site's operation or attempt to breach the Site's systems.
Company Services
PhishingU provides phishing simulation services, information security training, red team exercises and additional security consulting services ("the Services"). Service descriptions on the Site are general only and do not constitute a binding offer. Any engagement for services is subject to a separate agreement between the Company and the client. The Company reserves the right to change, add or remove services at any time without prior notice.
Liability and Limitation of Liability
The Site and Content are presented "AS IS" without any warranty of any kind. The Company does not commit to continuous availability of the Site and is not responsible for any direct or indirect damage resulting from use or inability to use the Site. The Company is not responsible for the accuracy, completeness or timeliness of information on the Site. Any reliance on information appearing on the Site is at your sole responsibility. The Company shall not be liable for any damage, loss, lost profits, indirect or consequential damages arising from use of the Site.

Phishing Exposure Scan Policy
The Phishing Exposure Scan service ("Scan Service") allows you to check the email authentication records of your domain (DMARC, SPF, DKIM) and receive an initial risk assessment. This service is subject to the following terms: a. Scan Authorization: You represent and confirm that you are the owner of the scanned domain, or that you have received explicit written authorization from the domain owner to perform the scan. Scanning without authorization constitutes a breach of these terms of use and may constitute a criminal offense. b. Nature of the Scan: The scan checks publicly available DNS records only (DMARC, SPF, DKIM). The full EASM scan service checks external, publicly visible assets on the internet. The scan is non-intrusive - no direct access is made to systems, internal servers, internal networks or non-public assets, and no advance access credentials are required. c. Service Limitations: Scan results constitute an initial assessment only and do not constitute professional security advice. Scan findings may be partial and are not a substitute for a comprehensive professional security audit. PhishingU is not responsible for decisions made based on scan results. d. Data Use: The email address you provide to receive the report will be stored and used to send the requested report. Subject to your consent, we may send you additional cybersecurity information. e. Usage Restrictions: It is strictly prohibited to use the Scan Service to check domains without authorization, for business competition purposes, or for any other illegitimate purpose.
Changes to Terms of Use
The Company may update and change the terms of use at any time. Changes will take effect from the moment of publication on the Site. Continued use of the Site after publication of changes constitutes agreement to the updated terms. It is recommended to check the terms of use from time to time.
Jurisdiction and Applicable Law
These terms of use are subject to the laws of the State of Israel only. Any dispute arising from these terms will be heard in the competent courts in the Tel Aviv-Jaffa district, Israel.
Indemnification
You agree to indemnify the Company, its employees, managers and partners for any damage, loss, claim or expense caused to them as a result of your breach of these terms of use or as a result of your use of the Site.
Severability
If any provision in these terms of use is determined to be invalid or unenforceable, it shall not affect the validity of the remaining provisions. The other provisions will continue to be in full force.
Use of Company Name and Logo
You may not use the name 'PhishingU', the Company logo or any other trademark belonging to the Company without express written permission from the Company. Any unauthorized use will constitute a violation of intellectual property rights.
